The history of online gambling in the US wouldn’t be complete without UIGEA, the Unlawful Internet Gambling Enforcement Act.

While it’s a prominent piece of legislation, it’s often misinterpreted.

UIGEA was a last-minute add-on to the SAFE Port Act, signed into law by President George W. Bush in October of 2006. The Act targeted out-of-area gambling site providers, declaring it illegal for them to receive online payments for gambling pursuits.

It’s not legislation that affects Americans who use real money betting websites or online casinos.

Clarification on the 1961 Wire Act

In 1961, the Kennedy administration signed the Interstate Wire Act into law as an anti-organized crime measure by prohibiting sports betting activities crossing state lines.

However, the 2001 language was vague and open to interpretation.

It took three years of trying, as the New Jersey state legislature sought to approve legal online casino gambling since 2010. But in February of 2013, the Governor finally approved the plan after legislators agreed to a 15% tax.

By November, sanctioned Atlantic City casinos launched 13 betting sites with 125,000 registered online accounts in the first month.

Four years after New Jersey launched its successful online gambling service, Pennsylvania was next.

In 1992, the Professional and Amateur Sports Protection Act, otherwise known as PASPA, prevented states from allowing any sports betting programs.

Punters can thank New Jersey as its then-Governor Chris Christie led the charge against PASPA, taking the case for its reversal all of the way to the Supreme Court.

On May 14, 2018, sports bettors across the United States scored a victory, as the court ruled to overturn PASPA. It was declared unconstitutional as it violates basic constitutional principles designed to prevent Congress from asserting control over the states.

Another Reversal on the Wire Act – 2019
