The only forms of gambling regulated in The Peach State are the lottery and charitable gambling in the form of bingo and raffles. The minimum gambling age is 18 (Georgia Code, section 16-12-20.

Unauthorized gambling forms are outlined in the Georgia Code, Section 16-12-21. This states that a person commits the offense of gambling when a person wagers money or anything of value on any game involving dice, cards, or balls.

While most other states have concentrated on the operators of unlicensed gambling enterprises, Georgia has gone the extra mile by arresting gamblers as well as operators in gambling stings throughout the years.

Other offenses include betting upon the partial or final result of any game, contest, or performance of an individual participant in such games. The Georgia Code states that engagement in any of the above gambling offenses is a misdemeanor. This constitutes a fine of up to $1,000 or 12 months in jail, or both.

Lottery

The only regulated gambling accessible online is the Georgia Lottery. Tickets can be purchased via their website, which include instant win games and draw games such as Powerball or Mega Millions. GA Code 16-12-60 states that charitable gambling in the form of bingo is legal. Senate Bill 57 was introduced, proposing the authorization of regulated, taxable sports betting, including horse race betting, in Georgia. The bill was rejected in March 2023 when lawmakers voted 37-19 against it. Multiple bills were subsequently proposed with the aim of legalizing sports betting. All of them were passed through committee, but the Senate voted against them.

State Rep. Ron Stephens introduced legislation (HB 677 and HR 807) that outlined a proposal for a constitutional amendment that would authorize casino gambling in the state. He also proposed a bill that would authorize the construction and operation of six commercial casinos. Stephans estimated that the success of this bill would result in an additional $250M for Georgia’s HOPE Scholarship Program and Pre-K Program. It would also create 10K construction jobs and 10K permanent jobs. The bill was ultimately withdrawn from consideration in March 2016.
