Despite its initial abhorrence of gambling, the state of Minnesota has legalized most forms of gambling. Tribal casinos thrive, and Minnesota also licenses commercial bingo halls, poker rooms, and the lottery. One of the few gambling enterprises not yet legalized in Minnesota is sports betting.

In 1858, Minnesota became the 32nd state to join the Union. In its first constitution, the state declared that “[t]he legislature shall not authorize any lottery or the sale of lottery tickets, other than authorizing a lottery and sale of lottery tickets for a lottery operated by the state.”

But that was then. Now, most forms of gambling are permitted, licensed or otherwise allowed. Any other form of gambling is tacitly prohibited by the state outlawing any and all bets—and then proceeding to carve exceptions to that prohibition with additional legislation.

One of those exceptions is for “private, social bets”, which for Minnesota’s purposes, is not a bet. This Alice in Wonderland concept allows for poker games in private homes and for impromptu and informal bets, such as those rising between friends or acquaintances. Unless your bet is one specifically authorized by the state of Minnesota (or one which the state does not consider a bet at all), you are committing a crime.

Tribal Casinos

Minnesota’s eleven federally-recognized Indian tribes do all the heavy lifting as far as casinos are concerned, and their 20+ tribal casinos are as close to Vegas-style gambling as you’ll get in the North Star State. The tribes also operate 21 smaller “truck stop”-level gambling enterprises.

Incidentally, tribal casinos in Minnesota are limited in the Class III games they can offer—blackjack and slot machines, to be precise. Banked Class III games such as baccarat, craps, and roulette are not allowed. On the other hand, poker and Class II games such as bingo and raffles are permitted.

Horse Racing

Off-track betting is technically not available, although wagers can be placed on simulcasts of races from around the nation, so long as they are placed on-premises at one of the state’s two horse racing tracks. And while the state allows parimutuel wagering, sports betting and sportsbooks are currently outlawed.

Online Gambling

So, is gambling online illegal? Well, placing a bet outside of the state’s definitions of what constitutes a legal “bet” is, in fact, a crime, but state law makes no mention of offshore gambling sites.

Since we’re not lawyers here at GS, we recommend that if you have concerns about the legality of online wagering in any form while in Minnesota, you consult a local attorney for guidance.

Lottery

Authorized by the legislature in 1989, the Minnesota State Lottery sells tickets throughout the state. It sold tickets online at from its website—and at gas pumps and ATMs—until 2015, when that practice was ended by the legislature. John Williams—a legal analyst for the Minnesota House Research Department—pointed out in his 2005 report “Gambling in Minnesota: A Short History” that “[w]hile the urge to gamble is probably older than written history, in Minnesota the urge to suppress gambling is older than statehood.”

And Minnesota’s long resistance to gambling provides considerable proof that Williams’ observation is true. That said, however, it does appear that the state is slowly moving into the 21st century. The proliferation in the past three decades of tribal casinos, racinos, bingo halls, and a state lottery all point in that direction.

Still, sports betting remains in limbo. At the time of this writing in October 2023, Minnesota House Bill 2000 is stalled in committee. The bill would authorize sports betting to take place in tribal casinos and through mobile apps linked to those casinos.

For the immediate future, sports wagering will remain the exclusive province of offshore sports books.
