Delaware permits live gambling in the form of horse race betting, sports betting, lottery, and video lottery games (Horse Racing Preservation Act of 1994. Online gambling restrictions were lifted when the Delaware Gaming Competitiveness Act of 2012 was enacted.

With this, regulated online gambling in the form of traditional lottery games, along with table games and video lottery games, was legalized. These options are now provided by Delaware’s brick-and-mortar video lottery agents. Although online sports betting was included in this enrollment of online gambling, neither of the state’s regulated operators at the time of reporting.

Online Gambling

In-state online gambling operations became legal in 2012 with the Delaware Gaming Competitiveness Act, and are overseen and governed by the Delaware State Lottery Office. As it stands, Delawareans can access casino games, poker, the lottery, and table games such as blackjack, roulette, and craps at any of the state’s regulated online gambling platforms.  Although legal, online sports betting is not yet available on any of these sites.

Until such time as those games do become available from in-state operations, offshore sites will continue to pick up the slack—and the sites we have recommended here all permit participation by Delaware-based players.

  • Horse Racing – Betting can only be accessed at offshore casinos at the time of reporting.
  • Lottery – The State Lottery is prohibited from selling lottery tickets online.
  • Poker – Online poker player pools are shared amongst players from Delaware, Nevada, and New Jersey.
  • Sports Betting – Not currently offered at any regulated online casinos and can only be accessed at offshore gambling sites. 

Offshore Gambling

Since offshore gambling operations are overseen by regulating authorities in different jurisdictions, local Delaware gamblers can enjoy the full spectrum—and rewards—of gambling.

By the way, to date, there appears to be no evidence of anyone in the U.S. (much less Delaware) being prosecuted for placing a bet online. Most states tend to concentrate on shady gambling operations and violations concerning fairness, cheating, or outright fraudulent practices from said operations. Social Gambling

Gambling within the bounds of a private or residential setting, otherwise known as social gambling, is not expressly alluded to in any of the state’s legislative acts. Therefore, there are currently no laws defining the legal status of Delawarean involvement in gambling activities that do not involve a profiting house.

Lottery

Traditional lottery game tickets for games such as Powerball and Mega Millions are available for purchase at over 600 registered Lottery vendors by players over 18 years old. Video lottery, sports lottery, and lottery-like games are available at any of the state’s three brick-and-mortar racinos and can be played so long as you meet the minimum age requirement of 21. These games can also be played online at any of these three operators’ online gambling platforms. 

Land-Based Gambling Options in Delaware

At the time of writing, almost all forms of gambling are available at the state’s three live gambling establishments: Delaware Park, Harrington Raceway, and Bally’s Dover (formerly known as Dover Downs). These establishments also run the only regulated online gambling sites in Delaware. Gambling options available include casino games, table games, poker, horse race betting, and sports betting.

Horse racing in Delaware began in 1937 when the state’s first race track was built (Harrington Raceway). This came long before the legalization of casino games, which were first introduced in 1994 (Horse Racing Preservation Act) at the state’s three racetracks. These establishments offer horse race betting in the form of harness racing and thoroughbred racing, with Delaware Park being the only establishment to offer the latter.

These racinos now house the state’s only regulated video lottery terminals which are machines that operate like regular slot machines, with the exception that they are remotely controlled offsite by the Delaware State Lottery – the state-appointed gambling regulatory authority. There are a variety of casino games, video slots, video Keno video poker, and video blackjack.

Delaware was the first state to legalize online poker in the US with the enactment of the Delaware Gaming Competitiveness Act of 2012. Legal poker rooms are now hosted by each of the state’s racinos. There is a strict age limit of 21 or older on no-limit Texas hold ’em and limit Omaha tournaments, regardless of whether they are hosted by a licensed casino or charitable organization. According to the Act, vendors can only offer a maximum prize value of $5,000 per single game or a maximum combined total prize of $13,000 per tournament. 

DE was also one of few states to be exempt from all the federal restrictions outlined in the Professional and Amateur Sports Protection Act of 1992, which completely outlawed most forms of sports wagering in the majority of the US. This small but significant exemption made it possible for Delawareans to partake in three-team parlay NFL bets, which took place under the watch of the Delaware Lottery.

As of 2018, following the repeal of PASPA, Delaware became the second state to legalize live sports betting. Now, all three of the state’s racinos offer sports betting on pro hockey, football, basketball and baseball, auto racing, horse racing, and college basketball and football. However, Delaware residents may not bet on any in-state college games, as is the case with most states. 

Unfortunately, these sports betting options are only available in person because none of the state’s gambling locations have launched a sports betting category on their internet-based platforms yet. Players can opt to travel to neighboring states like Maryland, Pennsylvania, or New Jersey to make online sports wagers but this ultimately eliminates one of the top online gambling drawcards – convenience.

Lottery

Governor Sherman Tribbitt signed House Bill 647 in 1974, marking the establishment of the Delaware State Lottery. The first lottery game took place in 1975 in the form of a horse race lottery. With the exception of a couple of lottery gambling options, Delawareans can partake in lottery games if they are over the age of 18. 

Delaware Lottery products on offer include instant games, keno, video lottery, sports lottery, and multi-state lottery games like Powerball. Tickets can only be purchased at live lottery-registered retailers (not online).

Bingo

Charitable organizations, along with educational or religious institutions, can obtain gaming licenses that authorize them to host bingo events under specific conditions. These include restrictions on prize limits. Per single game, the bingo host may only offer a maximum of $350 as a prize. There is also a limit of $3,000 on the combined sum of all prize pots at a single event.

Bingo hosts must also follow a set of other rules, including a minimum age limit of 14 for event waiters/runners and a maximum of 40 bingo games per single event. Before obtaining a license, event organizers will need to agree to terms associated with the distribution of the event proceeds for charitable causes.
